Mishandled Electronic Information Could Land Businesses in Litigation

Businesses today find themselves deluged with electronic files, documents and records that require special handling, protection and preservation, a lack of which can come back to bite a company, particularly in court.

Tulsa attorney Gerald Jackson said that electronically stored information (ESI) brings with it a whole raft of issues, which can be exacerbated by the growing number of employees who work in nontraditional settings, such as at home on their own computers.

“It’s going to be a bigger and bigger issue,” he said.

Jackson said law firms may be at less risk to a degree, because e-mails and documents created internally are generally privileged.
Jackson said he counsels clients to have an electronic discovery readiness plan for handling computerized information. That involves establishing policies and procedures for addressing such files, as well as determining how much and what kinds of data a company keeps.

Bridging the Gap

Six law students and 4 lawyers from Tianjin, China, visited Crowe & Dunlevy for a tour and to meet with firm attorneys. The visit was part of the Certificate in American Law program through Oklahoma City University School of Law. It's part of the law school's efforts to bridge the gap in understanding trade issues between China and the U.S., a relationship that increasingly would be needed as China's economic growth continues to soar.

An ongoing partnership between OCU and China's Nankai University School of Law allows law students at each school to experience the practice of law in each other's country. A visit to Crowe & Dunlevy was a unique privilege for the firm’s attorneys.

Karen S. Rieger

Karen S. Rieger is recognized by her clients and peers throughout Oklahoma to have vast experience on healthcare legal issues.  She joined Crowe & Dunlevy in 1981, and today, as a shareholder and director, serves as the Chair of the Firm’s Healthcare Section.  Her practice includes representation of healthcare institutions and practitioners throughout Oklahoma and surrounding states on a broad range of health law issues, including the Anti-Kickback and Stark laws, HIPAA privacy and security requirements, laws affecting tax-exempt and governmental healthcare providers, Medicare reimbursement rules, medical staff issues and others. Ms. Rieger has been listed in The Best Lawyers in America for Health Care Law since 1991. She recently was appointed a Commissioner to the Oklahoma Cerebral Palsy Commission, which operates a state-owned hospital for children with developmental disabilities.
